HASTINGS — Felony charges have been dismissed against a former District 33 legislative candidate who was alleged to have threatened and assaulted his wife.
Joshua Frederick, 28, is charged with terroristic threats, a Class 3A felony and committing intentional child abuse – no injury, a Class 3A felony.
An arrest warrant for Frederick was returned on Dec. 16, he posted bail the same day in the amount of 10 percent of $10,000.
Following a motion to dismiss the case by Frederick, Judge Natalie Nelsen-Pacey moved to dismiss the case without prejudice, which means the charges can be filed again.
According to the affidavit supporting arrest, a deputy with the Adams County Sheriff’s Office visited with Frederick’s wife, who wished to report a domestic assault that occurred during the evening of Dec. 1.
She alleged that Frederick had been verbally abusive throughout their marriage of six years. The couple have three juvenile children together, ages three, two and one.
It was also alleged that Frederick forbade her from attending church, speaking to pastors or counselors or communicating with friends. She said that he had been physically abusive three separate times in the last year.
During the Dec. 1 incident, Frederick’s wife said he became annoyed and stormed off to the bedroom, taking the children with him. She attempted to speak with him, but he repeatedly slammed the door.
It was reported that Frederick took her car keys and cellphone away. He later dragged her by the arm through the house while the three-year-old child pleaded form him not to hurt his mom.
Frederick was reported to have shoved her into a wall, grabbed her head and said, “This can get worse.”
Following the incident, she reported that she was in fear for her life as to what he might do next. She noted he had served in the military and owned several firearms.
The deputy noted that she had fresh bruising on her arms and wrists, and photos were taken of the markings.
Frederick was a candidate for the Nebraska Legislative District 33 primary race in May. He finished fourth and failed to advance to the general election in November.
