GRAND ISLAND — An investigation into an assault case resulted in a Grand Island woman being charged assault and child abuse after unlivable conditions were uncovered.
Kimberly Martinez, 48, has been charged with second degree assault, a Class 2A felony; use of a deadly weapon to commit a felony, a Class 2 felony; terroristic threats, a Class 3A felony; and two counts of negligent child abuse – no injury, both a Class 1 misdemeanor.
Martinez was arraigned in Hall County Court on Dec. 2 and she posted a personal recognizance bond. This type of bail allows a defendant to be released from custody without having to pay money upfront, they sign an agreement to appear in court as required.
A preliminary hearing has been set for Jan. 3, 2025, at 11:30 a.m.
According to court documents, an individual made a report at the Hall County Law Enforcement Center that he had been assaulted by Martinez, whom he had been living with.
They reported that they were struck with a pry bar, hit with a broom and that Martinez threatened to kill them and dispose of their body at a pig farm or landfill, according to the probable cause statement.
The individual had injuries that corroborated his report as they had multiple bruises that would be consistent with defensive injuries.
During the investigation on W. 4th St., officers found that the living conditions were unsuitable for two juvenile children due to a cockroach infestation and the presence of animal waste, food waste and garbage everywhere in the home.
There were also 19 cats that were removed from the home and housed with the Central Nebraska Humane Society.
The two children were removed from the home and housed with the Nebraska Department of Health and Human Services.
Martinez was arrested and booked into the Hall County Department of Corrections.
